Under the WTO accession
commitment of Vietnam, there is no definition of logistic service and Vietnam
committed to open the market access into the services auxiliary to all modes of
transport which are classified by the CPC system of the United Nations.
In details, from January
2014, the foreign investor may joint venture with the Vietnamese company
without any capital limitation or establish its’ wholly owned company in
Vietnam to engage in the following services auxiliary to all modes of
transport:
i.
Storage and warehouse services (CPC 742)
These services mean the
activities consisting of organizing and monitoring shipment operations on
behalf of shippers, through the acquisition of transport and related services,
preparation of documentation and provision of business information.
The foreign investor may
joint venture with the Vietnamese company without any capital limitation to
engage in other services (part of CPC 749) include the following activities:
bill auditing; freight brokerage services; freight inspection, weighing and
sampling services; freight receiving and acceptance services; transportation document
preparation services. These services are provided on behalf of cargo owners.
However, relating to the container handling services foreign service,
except services provided at airports (part of CPC 7411), the foreign investors
are only permitted to provide services through the establishment of joint
ventures with Vietnamese partners with the capital contribution of foreign side
not exceeding 50%.
